§1

Identity of the data controller

1. The administrator of personal data provided when using the Website and the Online Store run under the name www.odent.pl is Centrum Medyczne ODENT Sp. z o. o., NIP 525 28 87 815, REGON: 520631198, KRS: 0000937361, share capital: PLN 100,000.

2. W sprawach związanych z przetwarzaniem danych osobowych można kontaktować się z Administratorem pod adresem e-mail: recepcja@odent.pl lub pisemnie na adres siedziby Administratora.

3. Dane przetwarzane są zgodnie z aktualnie obowiązującymi przepisami prawa; tj. Rozporządzeniem Parlamentu Europejskiego i Rady UE 2016/679 z 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (dalej: RODO), ustawą z dnia 10 maja 2018 r. o ochronie danych osobowych, a także ustawą z 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną.

§2

Definitions used

The following definitions apply in this policy:

1. Serwis – serwis internetowy dostępny pod adresem www.odent.pl za pośrednictwem którego Użytkownik może przeglądać jego zawartość, kontaktować się z Administratorem danych oraz umówić się na konsultację lub wizytę.

2. Administrator danych osobowych – podmiot, który decyduje o celu i środkach przetwarzania danych, w niniejszej polityce rozumie się przez to: Centrum Medyczne ODENT Sp. z o. o., ul. Grzybowska 85/U4, 00-844 Warszawa.

3. Użytkownik – osoba fizyczna, której dane dotyczą i która korzysta z usług dostępnych w Serwisie/Sklepie.

4. Dane osobowe – wszelkie informacje, które bez nadmiernego czasu i kosztu mogą doprowadzić do identyfikacji osoby fizycznej, w tym jej dane identyfikacyjne, adresowe i kontaktowe.

Purposes of data processing

1. The personal data administrator processes personal data for the following purposes:

1. answering the question asked via the contact form or via the contact details available on the Website,

2. realizacji działań informacyjnych i promocyjnych dotyczących działalności Administratora zgodnie z obowiązującymi przepisami prawa,

3. pursuing rights and claims by the data controller or the data subject.

2. Dane osobowe przetwarzane są na podstawie:

1. art. 6 ust. 1 lit. a RODO – zgody osoby, której dane dotyczą, w zakresie, w jakim zgoda została wyrażona,

2. art. 6 ust. 1 lit. b RODO – w celu podjęcia działań na żądanie osoby, której dane dotyczą, przed zawarciem umowy lub w celu wykonania umowy,

3. art. 6 ust. 1 lit. c RODO – w celu wypełnienia obowiązków prawnych ciążących na Administratorze, w szczególności obowiązków wynikających z przepisów podatkowych i rachunkowych,

4. art. 6 ust. 1 lit. f RODO – w celu realizacji prawnie uzasadnionych interesów Administratora, w szczególności dochodzenia lub obrony przed roszczeniami, prowadzenia korespondencji oraz zapewnienia bezpieczeństwa Serwisu.

3. Podanie danych osobowych jest dobrowolne, jednak niezbędne do realizacji celów wskazanych w ust. 1, w szczególności udzielenia odpowiedzi na zapytanie, realizacji zamówienia oraz wystawienia dokumentów sprzedaży.

4. Failure to provide the required data makes it impossible to provide services, including orders and contact.

Methods of data acquisition

1. The User's personal data is collected directly from the data subjects, i.e. through: 

1. wypełnienie formularza z danymi kontaktowymi podczas składania zapytania przez formularz na stronie,

2. direct contact with the data controller using the contact details available on the website or in a traditional form at the place of business.

§5

Scope of processed data

1. The scope of processed personal data has been limited to the minimum necessary to provide services in the field of:

1. submitting an inquiry via the contact form or using the contact details available on the website: e-mail address, telephone number, name, any other data provided voluntarily by the data subject,

2. wystawienia rachunku lub faktury: imię i nazwisko lub nazwa podmiotu, adres siedziby, NIP.

§6

Data processing period

1. Personal data is processed for the period necessary to achieve the purpose for which it was collected, i.e.: 

1. for the duration of the concluded contract,

2. przez okres niezbędny do udokumentowania wykonanej umowy lub usługi, w tym wystawienia rachunku lub faktury – dane przechowywane są przez 5 lat, licząc od końca roku kalendarzowego, w którym upłynął termin płatności podatku,

3. for the period necessary to answer the question asked via the contact form or by phone,

4. until the consent is withdrawn, if the data processing is based on the consent of the data subject.

§7

Data recipients

1. The User's personal data may be entrusted to other entities in order to perform services at the request of the data administrator, in particular entities in the field of: 

1. website hosting, 

2. serwisu i utrzymania systemów informatycznych, w których dane są przetwarzane, w tym w celu obsługi zamówień, wystawiania faktur oraz innych procesów związanych z funkcjonowaniem Serwisu i Sklepu,

3. providing accounting services,

4. providing office services,

2. The User's personal data may also be made available to entities supporting the data controller, including entities providing courier and postal services, online payment services.

3. W przypadku korzystania przez Administratora z usług dostawców, których infrastruktura może znajdować się poza Europejskim Obszarem Gospodarczym, dane mogą być przekazywane do państw trzecich zgodnie z mechanizmami przewidzianymi w RODO, w szczególności na podstawie standardowych klauzul umownych zatwierdzonych przez Komisję Europejską.

4. We also process personal data of persons who:

1. zostały przekierowane na profil firmowy Facebook i Instagram za pośrednictwem linku,

2. dokonały subskrypcji profilu firmowego poprzez kliknięcie ikony „Lubię to” lub „Obserwuj”  na stronie internetowej odent.pl lub „Obserwuj” bezpośrednio na profilu firmowym w serwisie Facebook lub Instagram,

3. Published their comment under any of the posts posted on the company profile on Facebook.

§8

Rights of data subjects

The data subject is entitled to:

1. the right to access the content of the data and rectify it,

2. the right to delete data, unless other provisions of law apply that oblige the data controller to archive data for a specified period 

3. the right to transfer data, provided that the basis for data processing is the contract or consent of the data subject, and the data processing is carried out automatically,

4. the right to object to the processing of data for direct marketing purposes, carried out by the data controller as part of a justified legal interest, as well as to limit processing,

5. the right not to be subject to automatic profiling, if the data controller would make decisions based solely on automatic profiling and having legal effects for the data subject or similarly affecting him or her,

6. the right to control data processing and information on who is the data controller, as well as to obtain information about the purpose, scope and method of data processing, the content of this data, the data source, as well as the method of sharing, including the recipients or categories of data recipients,

7. the right to withdraw consent at any time, if the basis for data processing was the consent of the data subject. Withdrawal of consent does not affect the lawfulness of the processing carried out on its basis before its withdrawal,

8. the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO), if the person considers that the processing of their data is inconsistent with the currently applicable regulations in this regard.

9. In order to exercise the right to control data, access to data content, correct them, as well as other rights, please contact the data administrator.

§9

Final Provisions

1. The data administrator reserves the right to change this privacy policy, especially if it is required by the applied technical solutions, changes in the law regarding the privacy of data subjects or other significant changes affecting the content of information provided to Users.

2. In the event of a change in the applicable privacy policy, appropriate modifications to the above provision will be introduced, which will be effective from the date of their publication on the Website/Store website.
